www.piniparma.com («hereinafter the "Website") is published by the PINI.PR SAS company with registered head office situated at 63, Rue la boétie – 75008 Paris, registered with the Paris Company and Trade register under n°825025281, with an intra-community VAT no.  FR90825025281.

The General Terms and Conditions of sale (hereafter referred to as TACS) detailed below apply to all orders of products or services placed on the website (« the products ») by any person (« the customer »). Placing an order by a customer implies complete adherence, without reservation, to the TACS.
PINI.PR SAS reserves the right to adapt or modify the TACS at any time. The version of the TACS applicable to any transaction are the TACS's published at the date and time of the order. Consequently, placing an order by a customer implies complete adherence, without reservation, to these TACS.
The TACS below apply to all orders of products and services placed via the Site (the "Products") from PINI.PR SAS, operating the PINI PARMA brand, by any person (the "customer "). The Customer declares that has read and accepted the TACS prior to the placing of its Order.

The Website is available to all users of the Internet network and is accessible 7 days a week, 24 hours a day, subject to any interruptions, planned or unplanned, by PINI.PR SAS or its providers. Due to technical maintenance and/or security reasons or any cases or circumstances outside of its control.  PINI.PR SAS Is not liable for any damage incurred by any circumstances resulting in the unavailability of the Website.
PINI.PR SAS does not guarantee the availability or accessibility of the Website nor does it guarantee the Website against any anomalies, errors, bugs, breakdowns, interruptions of access to the Website and does not guarantee that the content on the Website or the services it provides will be delivered without interruptions, timely or error-free.

2 – TO PLACE AN ORDER

2.1 REGISTERING

To be able to place an order the customer must first register themselves on the Website and create an account with their details.

After registering, PINI.PR SAS will validate the registration and send the customer an email confirming the registration.

When creating an account, please control that all the personal details given are correct. Please remember to always update any personal information. In the event of an error in the given destination address, PINI.PR SAS will not be responsible if the goods are not delivered.

When signing up to the Website you must declare to PINI.PR SAS to be over the age of 18 and to be able to act with legal capacity and comprehension within the law. PINI.PR SAS has the right to remove and cancel an account (without giving motives) at any time and at their discretion.

The TACS apply to the product once the order, including the details of the articles, their price and any associated expenses have been validated by the customer.

2.2 THE PRODUCTS

The products offered for sale are those offered at the time of consulting the Website while stocks last. The information on the Website is automatically updated in real time, nevertheless while updating, a number of errors could occur for varied reasons, PINI.PR SAS cannot be held responsible for any errors which could occur during these updates.

PINI.PR SAS does its upmost to guaranty that the quality of the photographs on the Website give a true representation of its products. Due to digital representation of images on the internet, it could occur that the presentation of the product does not conform to the photographic representation of the product, this is a fact that the customer must understand and hereby accept.

If a product is out of stock at the time of viewing it on the Website, the customer can choose to be informed by email of when it will be again in stock by clicking on the specially assigned button in his email.

2.3 ORDER CANCELLATION

We strive to fulfill our customers expectations. In certain rare circumstances it could occur that PINI.PR SAS is not able to complete a placed order after the email of acceptance of the order has been sent to the customer. PINI.PR SAS cannot be held responsible for the withdrawal of any article from its Webpage at any time without giving any prior notice to its customers, or to refuse to fulfill an order even after the email of confirmation has been sent.

If after an order has been placed, it is discovered that the order is partially or wholly out of stock, the customer will be informed by email of the partial delivery or cancellation of the order. In the case of an order in which an article or articles of that order are out of stock, the customer has the right to be refunded the price of the article or articles which were out of stock.

In case a customer wanted to cancel an order after it had been shipped, the customer can refuse acceptance of delivery and by paying the cost of returning the order.

PRICES AND TERMS OF PAYMENTS

On the Website the prices are quoted in Euro’s, Pounds Sterling and American Dollars. The prices on the website are indicated with VAT included for customers who buy and reside in EU countries, but the price are also indicated VAT excluded for customers who reside and require delivery in a non-EU countries. 

FOR NON-EU CUSTOMERS: PRICE IS ALREADY EXCL. 20% VAT

Customs duties are at customer charge excepted for the United States, UK, Switzerland, Hong Kong, Singapore, Norway, Israel,Turkey, Jordan, Australia and Canada

Any Customs Tax and Duties and any other form of taxation (except the previously mentioned TVA, VAT, SALES TAX) are not included in the prices quoted on the Webpage. These taxes, when they apply, must be played by the customer directly to the transport agent.

The prices on the Website do not include shipping and delivery. These costs will be calculated and shown on the Webpage before the final confirmation of the order.PINI.PR SAS has the right to change the price of any and all of its articles at any time. The price of any article in stock will be that shown on the Website at the time of confirmation of the order.

Payment of the products can be made by Credit Card, PayPal, Alma and Bank transfer by simply following the instructions found on the checkout page.

The accepted Credit Cards are: Visa, American Express, MasterCard and Apple Pay.

Payments are settled by the security system Stripe using the SSL protocol (Secure Socket Layer),So that the information transmitted is encrypted by software and that no third party can read it during transport on the network.

The products are payable on the day of the order. Customer gives the PINI.PR authorization to debit their account to the amount of the products ordered. Once the order and the payment are validated by PINI.PR SAS, the order will be shipped.

The Customer warrants to the PINI.PR that it has the necessary authorizations to use the method of payment when placing the Order. If the bank or the credit card company refuses to authorize a payment, or the PayPal account is not debited. The order will not be validated and the product will not be sent. In this case,PINI.PR SAS will send an email to the customer informing of the refusal.

The customer's account will be charged for the orders billed after confirmation of the Order.

In the event of non-compliance by a customer with the obligations under the TACS, and particularly in case of fraud or any attempt to fraud, and any incident of payment of the price of the Order, PINI.PR SAS reserves the right to refuse any order from the customer.

PINI.PR SAS may suspend or cancel any execution and / or delivery of an Order, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum due by the Customer to PINI.PR SAS, in case of a payment incident, or in case of fraud or attempted fraud relating to the use of the Website and the payment of an Order.

If the bank or the credit card company refuses to authorize the payment or if the PayPal account is not debited, then the Order will not be validated and the ordered article will not be dispatched. In this case PINI.PR SAS will inform the customer of the event.

The data recorded by PINI.PR SAS is kept and serves as proof of any financial orders or transactions.

The data recorded by the use of PayPal or Credit Card constitutes proof of a financial transaction.

For payment by bank transfer the details are indicated when choosing the payment method. The email address xxx@.com used to place the order and the order number received via email must be included in the description of the payment.

Please note that your order will only be validated and dispatched once the amount has been received. Depending on the bank, this operation may take 2-3 days.
Please note that we will cancel your order if your bank transfer is not credited to our account after one week from the date of placing your order.

4-DELIVERY

We ship worldwide using DHL, to ensure a fast, tracked and safe delivery. 
Shipping is FREE on all international orders of over € 100 except for Israel where shipping is free for orders over 1980 ILS.

Delivery time:
Once your product is shipped it usually takes

  • 48 hours (business days) for France
  • 2-4 business days for Europe (depending on country)
  • 3-4 business days for Rest of the World (except Russia where the shipment is made with the La Poste service and takes 2/4 weeks)

In certain countries outside of Europe additional tax (customs duties, import taxes) my apply and these must be paid by the customer upon arrival of the package in the country of destination.

After your order is dispatched, you will receive an automated email with a track & trace number so you can easily track your package.

If the country of delivery is not in our list of counties, then we invite our customers to contact us by email at : info@piniparma.com where we will do our upmost to help.

The deliveries will be made to the address indicated by the customer, therefore extra careful care must be taken to make sure that the information provided is correct. Special care must be taken when filling in the address (building, floor, house number, stairs, access code, name or number of the intercom etc.).

The delivery times on the Website are given as an estimate and only correspond to the average time needed for possessing and delivery.

When delivered, if the parcel is opened, damaged, faulty or in a bad condition the customer must refuse to accept the delivery and send it back. If the customer decides to accept the parcel then the customer must write on the delivery receipt that the acceptance is with reservations, stating the conditions and any problems with the parcel, then communicate the event to PINI.PR SAS and to the delivery company within 3 working days.

PINI.PR SAS cannot be held responsible or liable for any direct or indirect damages resulting from delays or damages due to delivery.

In case you did not receive your package, contrary to what DHL affirms on your parcel's waybill information, you have up to two months after receiving the fulfillment confirmation email to contact us to contest the delivery. Passed this period, Pini Parma cannot be held responsible for any loss or delivery issue of your order.

WITHDRAWAL RIGHT AND GUARANTEES

An order can be returned for a full refund or exchange within 30 days from the delivery date, the process is extremely easy and FREE WORLDWIDE on all orders. In case of a second return for the same order or the return of an exchange, the return fee will be at the customer's charge.

To receive the return label via email, the customer must contact PINI.PR by email at info@piniparma.com, with the order number, the name and the name of the product to be returned or exchanged.

The products shall be returned in their original packaging, with the original labels, and brand new, without having used or washed them.

Within a maximum of 14 business days from the receipt of the articles by PINI.PR SAS, (after the status of the articles has been examined) a refund will be made using the original payment method, or the shipping of the new items(in case of change of size or model).

Orders paid using a gift card or voucher cannot be refunded. The paid amount will be credited on the same giftcard/a new voucher. 

Please be aware that in-store purchases can only be refunded in-store. The refund will be made using the original payment method; if paid by credit card, make sure to bring the same card so that our in-store sales representatives can issue the refund. 
Online orders can be exchanged or refunded in-store.

The return is not possible for Made to Measure products.

If the customer does not adhere to the TACS including the conditions of return and exchange then PINI.PR SAS cannot proceed to refund any product in question. If the product is defective or different from the one ordered, then PINI.PR SAS will pay for the return of the product.

5 GUARANTEES

All products offered by the Company are subject to the legal guarantee of conformity provided for by law, in particular Articles L.217-4, L.217-5 and L.217-12 of the French Consumer Code, and Guarantee of hidden defects provided for in articles 1641 and 1648, of the French Civil Code.

If at the time of delivery a visible defect is encountered, the customer must immediately report this by sending an email containing pictures to info@piniparma.com .

PINI.PR SAS COMMITS ITSELF TO:

Either to exchange the Product for a different size, subject to stock availability.

Either replaces the Product with an identical or equivalent Product subject to stock availability.

Or refund the price of the Product ordered within thirty (30) days from the Buyer's request if replacement with an identical Product or equivalent has proved impossible.

6 - THE RETENTION-OF-TITLE CLAUSE

All the goods remain the property of PINI.PR SAS until the full payment of the price is completed. Full payment of the price means the actual collection of the payment and not the delivery of a document creating an obligation to pay.

The risk of loss or deterioration of the goods as well as the liability for the damage they may cause is transferred to the Buyer as soon as the goods are delivered.

 

7 - INTERLLECTUAL PROPERTY RIGHTS

All elements of this Site www.piniparma.com and the Website itself are protected by copyright, trademarks, designs and / or other intellectual property rights. These elements are the exclusive property of the PINI.PR. All rights are reserved.

These elements belong to PINI.PR SAS or they are used with the agreement of their owners.

Any use by the or reproduction of the company names, marks and distinct signs belonging to the Company is strictly prohibited except in the case of prior express agreement with PINI.PR SAS.

It is strictly forbidden to reproduce (except for personal and non-commercial use), publish, edit, transmit, distribute, display, remove, delete, and add to this Website and the elements and software contained.

 

8 –APPLICABLE LAW AND JURISDICTION

8.1 These General TACS are governed by French Law.

In the event of a dispute between the Client and PINI.PR SAS concerning the interpretation, performance or termination of the TACS, PINI.PR SAS strongly encourages the Client to contact the PINI.PR SAS in the first instance to attempt to resolve the disagreement amicably. PINI.PR SAS hereby notifies Clients that there are alternative dispute settlement options such as mediation or arbitration.

8.2 CONSUMER MEDIATOR

According to the article L612-1 and seq.of the French Consumer Code, every customer has the right to have recourse free of charge to a consumer mediator to attempt to resolve the disagreement amicably with a professional.

Since January 1st 2016, articles L 612-1 of the French Consumer Code state that customer has the right to have recourse free of charge to a consumer mediator to attempt to resolve the disagreement amicably with a professional. Before using the mediator service, customer must contact PINI.PR customer care to this email:info@piniparma.com. If customer has not contacted PINI.PR in the first instance in order to find an amicable solution, the mediator service referred to in this article cannot be used.
